These Terms of Service ("Terms") govern your use of execufranconsulting.com and the tools, downloads, and consulting services offered by ExecuFran Consulting ("we," "us," "our"). By using our site or purchasing our services, you agree to these Terms.
Not Legal, Financial, or Investment Advice
ExecuFran Consulting provides business and operational guidance based on our experience in franchise development and operations. We are not a law firm, and nothing we provide — including the Franchise Readiness Scorecard, a Franchise Readiness Assessment, or any consulting engagement — constitutes legal, financial, tax, or investment advice. Franchise offerings are regulated under the FTC Franchise Rule and by a number of states. Our work addresses business and operational considerations only; it does not replace, and should not be used in place of, the preparation and review of franchise documents by a licensed franchise attorney. We strongly recommend you engage independent legal, accounting, and financial counsel before offering or selling franchises.
Our Services
We work with business owners considering or building a franchise system. Our services fall into three categories:
- Free resources — the Franchise Readiness Scorecard and an introductory readiness call, provided at no cost and for general educational purposes.
- Franchise Readiness Assessment — a paid review in which we score your business against our readiness criteria using information you provide, and report the gaps we find. The assessment is an evaluation; it is not an implementation plan and does not include execution work.
- Consulting and development engagements — ongoing fractional franchise development and related project work, delivered personally by our team.
Specific deliverables, timelines, scope, and compensation for paid engagements will be confirmed in writing (including by email) before work begins. Where the terms of a signed engagement agreement differ from these Terms, that agreement controls.
How We Are Compensated
Our compensation varies by engagement and is set out in each client's written agreement. In addition to fees paid directly by a client, our compensation on some engagements includes a share of franchise fees and/or ongoing royalties generated by the franchise systems we help develop. We disclose the compensation arrangement that applies to your engagement in writing before work begins.
Payments
Payments are processed through HubSpot Payments and/or Stripe. By making a purchase, you agree to their applicable terms in addition to ours. Prices are listed in U.S. dollars and are subject to change without notice; the price in effect at the time of your purchase applies to that transaction.
Refund Policy
Because a Franchise Readiness Assessment is custom work prepared for you, assessment fees are non-refundable once we have begun work, except where required by law. For consulting and development engagements, refund eligibility will be addressed in the written agreement for that engagement. If you believe you were charged in error, contact us and we will review the matter in good faith.
Intellectual Property
All scorecards, frameworks, assessments, guides, and content we provide are the intellectual property of ExecuFran Consulting. When you receive or purchase one, you receive a personal, non-transferable license to use it for your own business purposes. You may not resell, redistribute, publicly share, or repurpose our materials for commercial resale without our prior written consent.
No Guarantee of Outcome
Franchise development involves inherent risk. We do not guarantee that any business we assess will be suitable for franchising, that any franchise system we help you build will achieve specific results, or that any particular number of franchises will be sold. Our assessments and services are intended to inform your decision-making, not to replace your own judgment or due diligence.
Limitation of Liability
To the fullest extent permitted by law, ExecuFran Consulting and its founders shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website, tools, or services, including but not limited to lost profits or investment losses. Our total liability for any claim arising from our services is limited to the amount you paid us for the specific service giving rise to the claim.
User Conduct
You agree not to misuse our website or services, including by attempting unauthorized access to our systems, interfering with the site's operation, or using our tools in violation of applicable law.
Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of our site or services after changes are posted constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
